Atlanta Gas Light Tankless Water Heater Giveaway Official Rules

NO PURCHASE OF ANY PRODUCT OR SERVICE IS REQUIRED TO ENTER OR PARTICIPATE IN THIS PROMOTIONAL SWEEPSTAKES.  
The Atlanta Gas Light Tankless Water Heater Giveaway (the “Giveaway”) is sponsored and administered by Atlanta Gas Light (“Sponsor”), located at 10 Peachtree Place, 10th Floor, Atlanta, Georgia 30309. The Giveaway begins January 1, 2024 and ends December 31, 2024 (the “Giveaway Period”). All entries become the property of Sponsor, and Sponsor reserves the right to withdraw or terminate this offer at any time.

Eligibility Requirements: The Giveaway is open to persons who: (1) at the time of entry are at least eighteen years of age; (2) own and reside in a dwelling that is currently not using natural gas water heating and within Atlanta Gas Light’s service territory in Georgia (“Qualified Dwelling”); and (3) for entrants with existing natural gas service, account has have not had their gas service shut off for non-payment during the period that is 12 months preceding the beginning of the Giveaway Period. Employees, contractors, officers, and directors of Atlanta Gas Light, and their respective parent companies, subsidiaries, affiliates, and agents and those individuals that are involved in the development or execution of this Giveaway or any of its materials, and the immediate family (spouse, parents, siblings, and children) and household members (whether related or not) of each such person are not eligible.  Sponsor reserves the right to verify the eligibility of all entrants.

Agreement to Official Rules: Participation in the Giveaway constitutes each entrant’s full and unconditional agreement to these Official Rules and the Sponsor’s decisions, which are final and binding in all matters related to the Giveaway.  Winning the Giveaway and receiving any Prize is contingent upon fulfilling all requirements set forth in these Official Rules.  This Giveaway is void where prohibited by law.

How to Enter:
Eligible persons may enter the Giveaway by submitting an entry form that can be found at atlantagaslight.com/giveaway or by emailing AGLGiveaway@southernco.com during the Giveaway Period with Water Heater Giveaway included in the subject line and entrant’s full first and last name, address, telephone number and email address in the body of the email. Alternatively, eligible persons may enter the Giveaway by sending a postcard or letter containing the entrant’s full first and last name, address, telephone number and email address (if available) to: Atlanta Gas Light, Tankless Water Heater Giveaway, 10 Peachtree Place NE, BIN 110, Atlanta, GA  30309. Any entry received after the Giveaway Period will not be eligible.  Entries that are not complete or do not adhere to the Official Rules may be disqualified at the sole discretion of Sponsor. Eligible persons may enter only once. Eligible persons that use fraudulent methods or otherwise attempt to circumvent the rules may be removed from eligibility at the sole discretion of Sponsor.  Sponsor is not responsible for lost, late, stolen, damaged, incomplete, invalid, unintelligible, garbled, delayed or misdirected entries, for technical failures of any kind, or any human error which may occur in the receipt or processing of entries. Sponsor will not share your personally identifiable information (such as name or email address) with third parties without your consent.

Prize: Each Winner (as defined below) will receive one Rinnai RL75 natural gas tankless water heater (list price of $1,503) plus installation and removal of old water heater (approximate retail value up to $2,000) (the “Prize”).  Odds of winning depend on number of eligible persons participating in the Giveaway.  Eligible persons may enter only once.

Drawing Process: On or about each of the following dates (each such date on which a drawing occurs, a “Monthly Drawing Date”) Sponsor will randomly draw fifteen (15) entries from among all eligible entries received as of the end of the month preceding such Monthly Drawing Date: January 15, 2024; February 15, 2024; March 15, 2024; April 15, 2024; May 15, 2024; June 15, 2024; July 15, 2024; August 15, 2024; September 15, 2024; November 15, 2024; and December 15, 2024.   Each entry drawn will be used to determine the potential winner of a Prize (each a “Potential Winner” and collectively the “Potential Winners”).  Each Potential Winner will be notified by electronic mail and/or telephone using the contact information provided in their entry (“Prize Notification”) to confirm the Potential Winner’s full name and a mailing address (“Mailing Information”) and the Potential Winner must respond as instructed in the Prize Notification within seven (7) calendar days of the date of the Prize Notification (the “Deadline”) with Potential Winner’s Mailing Information. Each Potential Winner’s mailing address must be a street address (no P.O. Boxes). If the Sponsor does not receive a Potential Winner’s response to the Prize Notification by the Deadline, such Potential Winner will be disqualified and an alternate Potential Winner (for each unclaimed Prize) will be selected from all remaining eligible entries. Sponsor is not responsible for the failure for any reason whatsoever of any Potential Winner to receive their Prize Notification or for Sponsor to receive any Potential Winner’s response. The inability of Sponsor to contact a Potential Winner, the failure of a Potential Winner to contact Sponsor in a timely manner, the inability of a Potential Winner to accept or receive the Prize for any reason, the return of any Prize as undeliverable, and/or the non-acceptance by a Potential Winner of any Prize for any reason will result in disqualification of such Potential Winner, and alternate Potential Winner(s) will be selected randomly from all remaining eligible entries received until the Winner is selected. Only two (2) alternate Potential Winners may be determined, after which the applicable Prize may remain unawarded in Sponsor’s discretion.  Each Potential Winner who complies with all of the foregoing requirements and ultimately receives a Prize is known as a “Winner”.  Once an entrant is selected as a Potential Winner, such entrant will not be eligible for any subsequent drawings.  There is a limit of one prize per Qualified Dwelling. The Winner is not eligible for any other Atlanta Gas Light incentives or rebate offers associated with their new natural gas tankless water heater. To receive a Prize, each winner must sign and return an affidavit of eligibility and liability and publicity release, which must be in form and substance satisfactory to the Sponsor and received by the Sponsor no later than three calendar days after the Deadline.

Winner Requirements: Prize must be installed at the winner’s Qualified Dwelling. Installation must be completed within one month of the Prize Notification, otherwise the Winner will forfeit the Prize. The installing certified natural gas contractor will confirm to the Sponsor that the natural gas tankless water heater replaced an existing electric or propane water heater. If the certified natural gas plumber confirms that a natural gas water heater already existed at the premise, the Winner will forfeit the Prize. Prize includes the cost of a standard tankless water heater installation. The tankless water heater prize may not be sold by the winner to any other parties for a period of three years from installation, except to a purchaser of the entire dwelling. Failure to comply will result in the winner being responsible for the full cost of the Prize, including the retail cost of the tankless water heater ($1,503) in addition to the costs associated with the installation (up to $2,000).  If installation costs should exceed $2,000, Winner is responsible for all additional costs of installation payable to the installer.  Following installation, gas usage will be monitored at the subject service address by the Sponsor and at the Sponsor’s discretion to confirm compliance with winner Requirements. For Winners residing at an address that currently does not have natural gas service, a site visit will be conducted by Atlanta Gas Light to determine the requirements and associated costs of natural gas service installation. If allowable investment is not sufficient to cover the cost of the Main and Service Line requirement in the extension, the Winner shall pay the excess costs. The Winner has the opportunity to reject the Prize after these natural gas service installation costs are determined.

Prize Conditions: Selection and specifics of all Prizes will be determined at Sponsor's sole discretion. All Prizes are subject to availability. Winners are not entitled to any surplus between the actual retail value of his/her Prize and its stated approximate retail value; and any difference between the stated approximate retail value and actual value of the Prize will not be awarded. No cash redemption or prize substitution allowed, except by Sponsor, who reserves the right in its sole discretion to substitute cash value or another prize it believes is of equal or greater value. All prizes are non-transferable. All Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). Acceptance, installation and/or use of the Prizes are at the Winners’ sole risk and Sponsors are not responsible for damages whatsoever, including special, indirect, or consequential damages, arising out of or in connection with the installation, use and/or misuse of any of the Prizes.  Each Winner must contract directly with the installing certified natural gas contractor for installation of the Prize, and such contractor is solely responsible for installation.  

Taxes: All applicable taxes are the sole responsibility of the Winner. Each Winner may be issued a 1099 tax form for the fair market value of the Prize.

Release: By entering this Giveaway, each entrant, on behalf of the entrant and its successors and assigns, hereby: (i) releases and discharges the Sponsor, FACEBOOK® and any other party associated with the development or administration of this Giveaway, and their respective parents, subsidiaries, and affiliated entities, and each of their respective officers, directors, members, managers, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Sponsor Entities”), from any and all liability whatsoever in connection with this Giveaway and/or the acceptance, installation, use or misuse of a Prize, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”); (ii) agrees to indemnify the Sponsor Entities from any and all liability resulting or arising from this Giveaway, including, without limitation, any breach of a representation, warranty, covenant or agreement of the entrant in these Official Rules or in any other agreement or document entered into by entrant in connection with this Giveaway, and acknowledges that Sponsor Entities have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATIONS OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

DISPUTES: EACH ENTRANT AGREES THAT (A) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THIS GIVEAWAY, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND ANY JUDICIAL PROCEEDING SHALL TAKE PLACE IN A FEDERAL OR STATE COURT IN FULTON COUNTY, GEORGIA; (B) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS GIVEAWAY, BUT IN NO EVENT ATTORNEYS’ FEES; AND (C) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES (OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES) AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANT AND THE SPONSORS IN CONNECTION WITH THIS GIVEAWAY SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF GEORGIA, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS (WHETHER OF THE STATE OF GEORGIA OR ANY OTHER JURISDICTION), THAT WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THOSE OF THE STATE OF GEORGIA.

Winner’s List/Official Rules: For a list of winners or a copy of the Official Rules, please send a self-addressed stamped envelope to: Atlanta Gas Light, Tankless Water Heater Giveaway Winner's List/Official Rules, 10 Peachtree Place NE, BIN 110, Atlanta, GA  30309, to be received no later than the date that is 60 days after the end of the Giveaway Period. The names of the winners will be sent once the winners have been verified and prizes have been awarded.
